Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Dab Rite BTI, LLC ("Dab Rite," "we," "us"), operator of the Dab Rite BTI platform at dabritebti.com and its related features and services (the "Platform"). By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

THESE TERMS INCLUDE AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 11) AND AN INDEMNIFICATION OBLIGATION (SECTION 9) THAT AFFECT YOUR LEGAL RIGHTS.

1. Eligibility

You must be at least 21 years old (or the higher age required for cannabis-related content in your jurisdiction) to use the Platform. By using the Platform you represent that you meet this requirement, that you can lawfully enter into these Terms, and that your use of the Platform is legal where you are located. We may verify age and may suspend any account we believe is underage.

2. No Cannabis Sales; Store Merchandise

The Platform is an informational and community resource featuring the Best Temp Index ("BTI") and social features such as profiles, posts, comments, and follows. Cannabis remains a controlled substance under U.S. federal law. The Platform does not sell cannabis, does not process cannabis transactions, and does not connect buyers with sellers of cannabis. Nothing on the Platform may be used to offer, solicit, advertise, or arrange the sale or transfer of cannabis or cannabis products. You are solely responsible for complying with all laws that apply to you.

The only sales made through the Platform or its associated store are non-cannabis merchandise: Dab Rite products, BTI labels, and glass art pieces offered on consignment from independent artists in the Pure Craft Collective. Consignment pieces are handmade by independent artists who are solely responsible for their descriptions and craftsmanship. All purchases are subject to the store policies posted at the time of sale, including shipping, returns, and warranties.

3. Your Content and License to Us

"User Content" is anything you post or submit to the Platform, including temperature data, photos, videos, text, and profile information. You own your User Content, but you are solely responsible for it. By posting, you grant Dab Rite a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to host, use, reproduce, modify, distribute, publicly display, and create derivative works from your User Content to operate, promote, and improve the Platform and Dab Rite's products and services, including in Dab Rite marketing with attribution to your account. This license ends when your content is deleted from our systems, except for content re-shared by others, copies kept for legal or backup purposes, and aggregated or de-identified data (such as BTI statistics), which we may retain and use indefinitely.

You represent that you own or have all rights needed to post your User Content and that it does not infringe anyone's intellectual property, privacy, or publicity rights.

4. Maker and Brand Compliance

Makers and Brands (hash makers, extractors, processors, and cannabis brands, together with ancillary brands such as glass artists, accessory makers, and equipment companies, in each case with profiles or BTI listings, collectively "Makers") additionally represent, warrant, and covenant on a continuing basis that:

  • They hold and maintain all licenses, permits, and registrations required for their business, if any, in every jurisdiction where they operate;
  • All content they upload complies in all respects with the laws and regulations of their own state, province, territory, and locality, including rules on cannabis advertising, marketing, labeling, product claims, and audience restrictions;
  • Their content does not offer to sell cannabis, solicit purchases, or target consumers in jurisdictions where that content is unlawful;
  • All product and process claims are truthful and substantiated, with no prohibited medical claims; and
  • They, not Dab Rite, are solely responsible for monitoring legal changes and removing or updating any content that ceases to comply, and will promptly notify us of any license suspension or compliance issue.

Dab Rite does not review or approve content for legal compliance, and publishing or featuring content does not shift responsibility away from the Maker. Breach of this Section is a material breach of these Terms.

5. Acceptable Use

These rules apply to everyone on the Platform, including Makers, brands, and users who only browse, react, or comment. You agree not to:

  • Post or share content that is unlawful, infringing, false or misleading, defamatory, threatening, bullying, or harassing
  • Post hateful or discriminatory content, including attacks on any person or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age
  • Post content that is obscene, pornographic, sexually explicit, or gratuitously crude or vulgar, or that glorifies violence or self-harm
  • Post content directed at or appealing to persons under 21
  • Use the Platform to buy, sell, or transfer cannabis
  • Impersonate others or misrepresent an affiliation
  • Spam, flood, or post repetitive or off-topic promotional content
  • Scrape, harvest, or collect data or content by automated means
  • Interfere with the Platform's operation or security
  • Manipulate reviews, rankings, or BTI data

We may remove any content and suspend or terminate any account at any time, with or without notice, in our sole discretion, but we have no obligation to monitor content.

6. BTI Data Disclaimer

BTI temperatures and related data are submitted by Makers and community members. They reflect personal opinions and preferences, are not verified by Dab Rite, and are not safety standards or professional advice. Dabbing involves inherently hot surfaces and equipment. Use your own judgment and equipment safely. Dab Rite is not responsible for any injury, loss, or damage arising from reliance on Platform content.

7. Intellectual Property; Copyright Complaints

The Platform and its design, software, trademarks (including DAB RITE and BTI), and content other than User Content belong to Dab Rite or its licensors. We respect intellectual property rights and respond to notices under the Digital Millennium Copyright Act. Send copyright infringement notices containing the information required by 17 U.S.C. ยง 512(c)(3) to our designated agent at Copyright Agent, Dab Rite BTI, LLC, 140 School Street, Kenmore, NY 14217, legal@dabritebti.com. We may terminate repeat infringers.

8. Disclaimers and Limitation of Liability

The Platform and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We are not responsible for User Content or the conduct of any user. To the maximum extent permitted by law, Dab Rite and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Platform, and our total liability for all claims will not exceed the greater of one hundred dollars ($100) or the amount you paid us in the past twelve months. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dab Rite BTI, LLC and its affiliates, owners, members, managers, officers, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, demands, actions, losses, damages, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your User Content, including any claim that it violates the law of any jurisdiction, including your own state, province, or territory, or infringes any third party's rights;
  • your use or misuse of the Platform;
  • your breach of these Terms, including for Makers any breach of the representations in Section 4; or
  • your violation of any law or the rights of any third party.

We may assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate and not to settle any such matter without our prior written consent. This obligation survives termination of these Terms.

10. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access at any time, with or without cause or notice. Sections 3, 4, and 6 through 12 survive termination.

11. Dispute Resolution; Arbitration; Class Action Waiver

Except for small claims court matters and claims for injunctive relief regarding intellectual property, any dispute arising out of these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Dab Rite each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing help@dabritebti.com within 30 days of first accepting these Terms.

12. General

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules, and any claims not subject to arbitration must be brought in the state or federal courts located in Erie County, New York. We may update these Terms by posting a revised version with a new effective date; continued use after changes constitutes acceptance. If any provision is unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Dab Rite regarding the Platform. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may.
